General Terms

This Terms of Use Agreement ("Agreement") is a legally binding contract between you, either as an individual or on behalf of an entity (“you”), and Extrovert (“we,” “us,” or “our”). This Agreement governs your access to and use of the goextrovert.com website along with any associated media forms, channels, mobile website, or linked web applications (collectively referred to as the “Site”).

By accessing the Site, you confirm that you have read, understood, and consent to be bound by all terms and conditions of this Agreement, which includes our Privacy Policy. If you disagree with any part of these terms, you must cease using the Site immediately.

We may post additional terms and conditions or documents on the Site periodically, which are explicitly incorporated into this Agreement by reference. We reserve the right to amend or modify these terms at our discretion at any time, for any reason. Changes will be communicated by updating the "last updated" date of this Agreement, and you waive any right to receive specific notice of each change.

It is your responsibility to review these terms regularly to stay informed of updates. Your continued use of the Site after the posting of revised terms means that you accept and agree to the changes. You are bound by such revisions and should therefore periodically visit this page to review the current terms to which you are bound.

The Site is not intended for distribution to, or use by, any person or entity in any jurisdiction or country where such distribution or use would be contrary to local law or regulation, or which would subject us to any registration requirement within such jurisdiction or country. Those who choose to access the Site from other locations do so on their own initiative and are responsible for compliance with local laws, to the extent applicable.

The Site is specifically designed for professional use, and consumer protection laws may not apply to users of the Site. By using the Site, you acknowledge that you are engaging with the Site for professional purposes.

Users must be at least 18 years old to use the Site. Access to or use of the Site by anyone under 18 is strictly prohibited and constitutes a violation of this Agreement.

You acknowledge that you have chosen to subscribe to the Services with a full understanding of the risks associated with them, including the level of risk you are willing to accept. The pricing agreed upon under this Agreement reflects these considerations and is fundamental to the economic balance of this Agreement.

Intellectual Property Rights

The Site is the proprietary property of Extrovert, and all source code, databases, functionality, software, website designs, audio, video, text, photographs, graphics on the Site (collectively, “Content”), and trademarks, service marks, and logos contained therein (“Marks”), are owned, controlled, or licensed by us. They are protected by copyright and trademark laws, and various other intellectual property rights and unfair competition laws of the United States, foreign jurisdictions, and international conventions.

The Content and the Marks are provided on the “as is” basis for your information and personal use only. Except as explicitly provided in these terms, no part of the Site and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.

You are granted a limited license to access and use the Site and to download or print a copy of any portion of the Content to which you have properly gained access solely for your personal, non-commercial use. We reserve all rights not expressly granted to you in and to the Site, the Content, and the Marks.
In cases where the data—excluding personal data—are protected by intellectual property rights, you grant to Extrovert a non-exclusive, royalty-free license to use such data for the duration of this Agreement and indefinitely thereafter. This data, collected, managed, processed, and/or shared by you in connection with the Services, may be used by Extrovert to enhance the Services. You are informed that you may opt out of this data usage for service improvement purposes by specifically requesting to withdraw from the service improvement program.

Extrovert is not produced, endorsed, or certified by LinkedIn. All LinkedIn™ logos and trademarks displayed on this tool are property of LinkedIn Corporation.

Your Data

"Your Data" refers to any data and content stored or transmitted via the Services by or on behalf of you or your end-users. This may include data you choose to import from third-party services, messages you send, files you upload, comments on files, and any other material you enter or upload into the Services.

In order to use our Services, you must link a third-party LinkedIn account to your Services account. By using the Services, you grant us permission to access your LinkedIn account, which allows you to send comments and messages or perform other actions on LinkedIn via Extrovert. You retain full ownership of Your Data, and we do not claim any ownership of it.

We require the ability to transmit, store, and copy Your Data to display it to you and your teammates, index it for search capabilities, make backups to prevent data loss, and more. Your acceptance of these Terms of Service grants us the necessary rights to perform these actions solely to provide the service and for no other purpose. This permission extends to using third-party service providers (such as Amazon Web Services, Google Cloud, OpenAI) in the operation and administration of the service. The rights granted to us are also extended to these third parties to the extent necessary for the provision of the service.

You are solely responsible for your conduct, the content of Your Data, and your communications with others while using the Services. It is your responsibility to ensure that you have all the necessary rights and permissions to comply with these Terms and to avoid infringement or violation of any rights of others. You will be responsible for ensuring your users' compliance with these Terms, using commercially reasonable efforts to prevent unauthorized access to or use of the Services, and notifying us promptly of any such unauthorized access or use.
We are not obliged to monitor any information on the Services, nor are we responsible for the accuracy, completeness, appropriateness, safety, or legality of Your Data or any other information or content you may access using the Services.

We process personal data on your behalf as a processor within the meaning of the GDPR. These terms and conditions incorporate the Data Processing Agreement (DPA). By signing these terms and conditions, you accept the DPA.

Additionally, in the event of support assistance with your problems, it may become necessary for us to access your records. This access can be conducted via a web meeting with you or through database analysis. You grant us the right to access your data for such purposes and agree to comply with the necessary protocols during such processes.

Content Responsibility

As a user of Extrovert, you are solely and completely responsible for any data, information, or content you distribute through the Service, including comments, posts, reposts, messages, or any content generated by third-party services such as OpenAI (hereinafter collectively referred to as "Content"). You hold full responsibility for the compliance of such Content with all applicable regulations and laws.

The Service includes features that generate drafts of comments and suggested actions. Although these suggestions are auto-generated, you explicitly agree to thoroughly review, approve, or correct them as necessary before use. You take full responsibility for this Content and for all consequences that may arise from its use, including legal, reputational, or other impacts.

You acknowledge and warrant that the Content, whether in whole or in part, shall not:

  1. Infringe, misappropriate, or violate any rights, particularly intellectual property rights, of any third party;
  2. Contain viruses or programs designed to damage, intercept, or misappropriate any system, data, or personal data in a fraudulent manner;
  3. Include unlawful, bullying, harassing, libelous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material, or any material that encourages behavior that could constitute a criminal offense, lead to civil liability, or otherwise violate any law;
  4. Contain sensitive personal data, such as social security numbers, individually identifiable health or health insurance information, bank account details, or credit card numbers;
  5. Be false, misleading, or inaccurate;
  6. Violate our Operating Policies.

You recognize that we have the right, though not the obligation, to monitor the Service and any Data submitted to it. To comply with legal obligations, we may take any action we reasonably deem necessary to prevent unlawful activity in connection with the Service.

You expressly acknowledge and agree that Extrovert shall not be liable for any loss or destruction of Content, including Data, and that you are responsible for maintaining appropriate backups of all Content.

Compliance with the Law

You agree to comply with all applicable laws and regulations in any country from which you access our Website and/or use our Service, as well as in any country to which you send messages using our Service. You shall indemnify and hold us harmless from any action brought against us, judgment entered against us, or loss we may sustain resulting from your non-compliance with applicable laws and regulations.

Furthermore, you agree to reimburse us for any action or formality we may be required to undertake to comply with a legal demand or request from an administrative or judicial authority in relation to your use of the Service.
In the event you become aware of any violation of these Terms or applicable laws and regulations by any third party, particularly if you become aware of or discover a security breach, you must immediately notify us by all means available, including by sending an email to support@goextrovert.com.

Credentials

By using the Site, you represent and warrant that:

  1. All registration information you submit is truthful and accurate, and you will maintain the accuracy of such information. This includes your surname, first name or corporate name, address, phone number, and a valid email address as necessary to process your orders and manage your account. You are responsible for any consequences arising from false or inaccurate information you provide.
  2. You have the legal capacity and agree to comply with these Terms of Use.
  3. You will not use the Site for any illegal or unauthorized purpose, and your use of the Site will not violate any applicable law or regulation.
  4. You are committed to maintaining the confidentiality and security of your account credentials, including User IDs and passwords. You agree to immediately notify us of any unauthorized use of your account or any theft or loss of credentials that could result in unauthorized access to the account.
  5. Your account is personal to you and may only be used by you or individuals duly authorized by you. You acknowledge that you may be held liable for unlawful, wrongful, or fraudulent use of the account, and you agree to indemnify and hold us harmless against any claims or actions arising from such use.
  6. We reserve the right to request proof of your identity or authority before granting access to your account.

This Data will be processed in accordance with our Privacy Policy, which details how we manage, process, and store your data in the context of providing our services.

Fees and Payment

You are required to pay fees for certain features of the Site. You agree to provide current, complete, and accurate purchase and account information for all transactions made at the Site. You further agree to promptly update your account and payment information, including your email address, payment method, and payment card expiration date, so that we can complete your transactions and contact you as needed.

We bill you through an online billing account for purchases made via the Site. Sales tax will be added to the price of purchases as deemed necessary by us. We reserve the right to change prices at any time. All payments must be made in U.S. dollars.

You agree to pay all charges at the prices then in effect for your purchases, and you authorize us to charge your chosen payment provider for such amounts. If your purchase involves recurring charges, you consent to our charging your payment method on a recurring basis without requiring prior approval for each recurring charge, until you notify us of your cancellation.

We reserve the right to correct any errors or mistakes in billing, even if we have already requested or received payment.

Renewal

Unless you notify us before the end of the applicable subscription period that you want to cancel a subscription, your subscription will automatically renew and you authorize us to collect the then-applicable annual or monthly subscription fee (as well as any taxes) using any credit card or other payment method we have on record for you.

Free Trial

We offer a 7-day free trial to new users who register with the Site. You will not be charged during your free trial, and you can cancel at any time. If you do not cancel before the end of the free trial period, your subscription will automatically continue, and you will be billed the subscription fee for the next cycle.

Cancellation

All monthly purchases are non-refundable. If you subscribe to an annual plan, you are eligible for a refund within 24 hours of the transaction if you change your mind. You may cancel your subscription at any time by contacting us at support@goextrovert.com or through your account settings. Your cancellation will take effect at the end of the current paid term.

Software

As part of our Service, Extrovert grants to you a non-exclusive, revocable, personal, and non-transferable license to use the software provided by Extrovert solely in connection with our services. This license is granted for the purpose of enabling you to use and enjoy the benefits of our services as provided by Extrovert, in the manner permitted by these Terms.

The software and any associated documentation are provided "as is" without any warranties of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Extrovert does not warrant that the software will function uninterrupted, that it is error-free, or that any errors will be corrected.

You agree not to:

  • Copy, modify, create derivative works of, reverse engineer, reverse assemble, disassemble, or in any way attempt to discover the source code of the software.
  • Rent, lease, loan, sell, distribute, sublicense, or otherwise transfer the software to any third party.
  • Use the software for any purpose that is unlawful or prohibited by these Terms.
  • Use the software to create any product or service that competes with the Extrovert service.

You accept any and all risks arising from the use and performance of the software. You are solely responsible for any damage to your computer system or mobile device, loss of data, or any other damage or injury that results from the use of the software.

Extrovert reserves all rights not expressly granted to you in these Terms. The terms of the software license granted herein are subject to change as provided in these Terms or in any related policies.

Prohibited Activities

In your use of our Service, you are prohibited from engaging in activities that we, at Extrovert, determine to be harmful to our Service, other users, or any third party. The following list outlines examples of forbidden activities while using our Service. This list is not exhaustive and may be updated at our discretion:

  1. Illegal Activities: Engaging in any activity that is illegal under applicable law, including but not limited to fraud, money laundering, illegal gambling operations, terrorist activities, or the promotion of these or other illegal activities.
  2. Abusive and Offensive Conduct: Publishing or transmitting any material that is bullying, harassing, libelous, defamatory, obscene, pornographic, racist, or discriminatory.
  3. Infringement of Rights: Uploading, posting, or otherwise transmitting content that infringes on any intellectual property or other proprietary rights of any party, or content that you do not have a right to make available under any law or contractual or fiduciary relationships.
  4. Manipulation of Services: Manipulating identifiers in order to disguise the origin of any content transmitted through the Service or performing any activity that disrupts the proper working of or access to the Service.
  5. Unauthorized Access: Attempting to gain unauthorized access to any portion or feature of the Service, or any other systems or networks connected to the Service or to any Extrovert server, or to any of the services offered on or through the Service, by hacking, password mining, or any other illegitimate means.
  6. Overburdening Infrastructure: Engaging in activities that impose an unreasonable or disproportionately large load on the infrastructure of the Service or Extrovert’s systems or networks, or any systems or networks connected to the Service.
  7. Use of Automated Systems: Using any robot, spider, scraper, or other automated means to access the Service for any purpose without our express written permission, including monitoring or copying any of the material on the Service.
  8. Unauthorized Commercial Activities: Using the Service for any commercial purpose or the benefit of any third party, except as explicitly permitted by us in advance.
  9. Damaging Content: Introducing any viruses, trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.
  10. False Information: Providing misleading or false information to us or to other users, including creating a false identity on the Service.
  11. Interference with Other Users' Enjoyment: Interfering with, disrupting, or creating an undue burden on the Service or the networks or services connected to the Service.
  12. Data Harvesting: Systematically retrieving data or other content from our Service to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.
  13. Security Testing: Conducting any systematic or automated data collection activities, including scraping, data mining, data extraction, and data harvesting on or in relation to our Service without our express written consent.
  14. Impersonation: Attempting to impersonate another user or person or using the username of another user.
  15. Disparaging Conduct: Engaging in any actions, communications, or conduct that could disparage, tarnish, or otherwise harm the reputation and functioning of our site or services.
  16. Unauthorized Framing or Linking: Engaging in unauthorized framing of or linking to the site.
  17. Improper Use of Support Services: Making improper use of our support services or submitting false reports of abuse or misconduct.
  18. Selling or Transferring Profiles: Selling or otherwise transferring your profile or account.
  19. Deleting Proprietary Notices: Deleting the copyright or other proprietary rights notices from any content.
  20. Reverse Engineering: Deciphering, decompiling, disassembling, or reverse engineering any of the software comprising or in any way making up a part of the Service.
  21. Bypassing Security Measures: Attempting to bypass any measures of the Service designed to prevent or restrict access to the Service, or any portion of the Service.
  22. Harassment of Employees or Agents: Harassing, annoying, intimidating, or threatening any of our employees or agents engaged in providing any portion of the Service to you.
  23. Unauthorized Information Collection: Uploading or transmitting (or attempting to upload or to transmit) any material that acts as a passive or active information collection or transmission mechanism, including without limitation, clear graphics interchange formats (“gifs”), 1×1 pixels, web bugs, cookies, or other similar devices.
  24. Disruption of the Service: Using or launching any unauthorized script or other software that interferes with the use, features, functions, operation, or maintenance of the Service.
  25. Use Contrary to Applicable Laws: Using the site in a manner inconsistent with any applicable local, state, national, or international laws or regulations.

You understand and agree that engaging in any of these prohibited activities may result in immediate termination of your access to the Service, potential legal action, and civil liability. We reserve the right to investigate and take appropriate legal action against anyone who, in our sole discretion, violates these provisions, including without limitation, removing the offending communication from the Service and blocking access to violators.

Extrovert reserves the right to take any action against any use of the Service that we consider prohibited or unauthorized, including but not limited to banning you from the Service, initiating legal action, or disclosing necessary information to authorities as required by law.

Right of Withdrawal

The Services provided by Extrovert are exclusively for professional use. Accordingly, consumer protection regulations, including any rights to withdrawal, do not apply to these Services.

Termination and/or Deletion of an Account by Extrovert

Extrovert reserves the right to terminate your account and discontinue the Services at its sole discretion under the following circumstances:
  • At any time and for any legitimate reason for users on a free plan, provided that reasonable notice is given.
  • Following a breach of any laws, regulations, or these Terms of Service. Breaches prompting termination include, but are not limited to:
  • Non-receipt of payment or partial payment of any sum due by you.
  • Payment incidents.
  • Use of the Services in a manner that does not comply with our Sending Policy.
  • Breach or attempted breach of the website’s security.
  • Fraud or attempted fraud during the use of the website.

Upon the termination or expiration of your account for any reason, all outstanding amounts owed by you will become due and payable immediately. Extrovert will not issue refunds for any prepaid fees and will charge you the full amount that would have been due for the remainder of the term if the agreement had continued in force.

Following the effective termination date of your account, you will no longer have access to your account or to any data stored within it. Access to and handling of the remaining data will be subject to the provisions of our Privacy Policy and applicable laws.

Limitation of Liability
The site and our services are provided on an "as-is" and "as-available" basis. You agree that your use of the site and our services will be at your sole risk. To the fullest extent permitted by law, we disclaim all warranties, express or implied, in connection with the site and your use thereof, including, without limitation, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law, Extrovert, as well as our directors, employees, agents, suppliers, or licensors, shall not be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, or for any damages relating to personal injuries or death, that result from the use of, or inability to use, the service.

Under no circumstances will Extrovert be responsible for any damage, loss, or injury resulting from hacking, tampering, or other unauthorized access or use of the service or your account or the information contained therein.

We make no warranties or representations about the accuracy or completeness of the site’s content, the content of any websites linked to the site, or the services offered through the site. We do not endorse, guarantee, or assume responsibility for any product or service advertised or offered by a third party through our site or any hyperlinked website or featured in any banner or other advertising.

Extrovert assumes no liability for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein; (iv) reputational damage; or (v) any claims by third parties in relation to the content distributed through Extrovert, even if the content was initially generated by our software. (vi) interruption or cessation of transmission to or from the Site; (vii) bugs, viruses, trojan horses, or the like which may be transmitted to or through our site by any third party (viii) ​any errors or omissions in any content or for any loss or damage of any kind incurred as a result of the use of any content posted, transmitted, or otherwise made available via the site.

LinkedIn does not allow the use of automation tools, third-party software, and extensions. Any violations of LinkedIn’s user agreement, such as the use of services like Extrovert, can result in warnings, temporary suspensions, or permanent bans of user accounts. By using Extrovert, you acknowledge and agree that the use of the service is at your own risk, and you agree to hold Extrovert harmless from claims for any resulting warnings, loss of data, or banned accounts.

Our total liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to Extrovert for the service during the twelve (12) month period prior to any cause of action arising.

Entire Agreement

These Terms of Use and any policies or operating rules posted by us on the Site constitute the entire agreement and understanding between you and us. No joint venture, partnership, employment, or agency relationship exists between you and us as a result of these Terms of Use or your use of the Site.

Waiver and Severability

Our failure to exercise or enforce any right or provision of these Terms of Use shall not operate as a waiver of such right or provision. If any provision or part of a provision of these Terms of Use is determined to be unlawful, void, or unenforceable, that provision or part of the provision is deemed severable from these Terms of Use and does not affect the validity and enforceability of any remaining provisions.

Assignment and Transfer

We may assign any or all of our rights and obligations to others at any time without notice to you. Under these terms, it is expressly agreed that you shall not transfer the Agreement or any rights derived from it to a third party without our prior written consent.

Subcontracting

We reserve the right to use subcontractors of our choice to provide the services in connection with the Services and shall remain liable for the performance of the services in accordance with these Terms.

Force Majeure

We shall not be liable for any failure to perform our obligations where such failure results from any cause beyond our reasonable control, including, without limitation, mechanical, electronic, or communications failure or degradation (including "line-noise" interference). If a Force Majeure event occurs, we may suspend our obligations under these Terms until the event ends. If the Force Majeure event continues for more than sixty (60) days, either party may terminate the Agreement by giving notice, effective immediately.

Relationship of Parties

Use of the Site and acceptance of these Terms of Use does not create a joint venture, partnership, employment, or agency relationship between you and Extrovert. Both parties remain independent entities at all times.

Interpretation of Terms
These Terms of Use shall not be construed against us solely because we drafted them. By using the Site, you acknowledge that you have read and understood all terms and agree to them.

Electronic Agreement

You agree that your electronic acceptance of these Terms, facilitated by your use of the Site and electronic interactions, constitutes an agreement binding and valid as a signature on paper. You waive any objection to the enforcement of these Terms based on their electronic form or the lack of a handwritten signature.
